Search and Seizure for Law Enforcement

Course Description

Through a combination of classroom presentation, discussion, and practical application, this course provides officers with guidance on the totality of the search and seizure process; from ethical considerations, to initial investigation, to search warrant application, to the warrant's execution and return. Utilizing the statutory provisions of the OCGA as well as published opinions of both State and Federal appellate courts as its basis, this course will examine a wide array of common, "in the field" warranted and warrantless search and seizure scenarios, under both the 4th Amendment's Katz and Jones theories of analysis, in order to assist the officer in the proper application of current standards to their circumstances at hand. 

 Officers can expect to receive instruction in basic legal research as well as information related to specific sources and source materials, all designed to aid them in the furtherance of their education and in remaining up to date on legal issues. The concept of peace officer liability in the search and seizure process will also be examined, specifically in reference to official immunity, qualified immunity, and "clearly established law".  Officers will additionally receive instruction on the use of the GPSTC Search Warrant Template and prepare a search warrant affidavit and command as a performance examination.

Prerequisites

Students must be a certified peace officer of the State of Georgia to attend.

Who Should Attend

The ability to apply for a Georgia search warrant is restricted by statutory provision of the Official Code of Georgia Annotated, only to certified peace officers of this State. It is therefore recommended that all such peace officers consider attending this training periodically, as search and seizure law is constantly and at times, rapidly evolving.

Special Notes

Prior experience in the drafting/writing of search warrants is NOT a prerequisite for officers to attend this class.
